On-line Bidding Terms: 1. Timber Creek Auction LLC. has put forth every effort in preparing the catalog for this auction to provide accurate descriptions of all items. All property is sold as is, where is and it is the bidder's responsibility to determine the exact condition of each item. Printed statements or descriptions by staff are provided in good faith and are matters of opinion. 2. FOR LIVE INTERNET BIDDING: There is an 20% Buyer's Premium added to the total. 3. All accounts must be settled at the conclusion of the auction. We accept Visa and Mastercard credit cards. Your credit card will be charged for your purchases, plus buyers premiums, and any taxes. A pre-auction authorization will be performed to establish available credit. Debit cards may show a hold on funds for a short period of time. NOTHING will be charged to your card until a purchase is made. Note that FFL transfer and shipping charges are separate and are to be paid to our FFL partner, Area 51 Tactical. EACH GUN will be subject to a $25 transfer and handling fee. Contact info for Area 51 is 334-589-3761. 4. It is the bidder's responsibility to take packing & shipping costs into consideration when bidding on items. Packing, handling, shipping, and insurance charges are the FULL responsibility of the purchaser. Timbercreek Auction Company will transport items to Area 51 Tactical in Dothan, AL. Purchasers will pay FFL, shipping & insurance charges DIRECTLY to Area 51 who is doing the shipping. EACH GUN will be subject to a $25 transfer and handling fee. Any disputes & claims occurring from shipping issues will be handled between the shipper and the purchaser. Timbercreek Auction Company is not responsible for items once they have transferred ownership. We estimate a 10 business day turn-around for our shipments. This estimate can change due to the amount of on-line bidders or holiday shipping delays. Items 25lbs and over is the responsibility of the highest bidder to find his or her own shipper and handler. We will help from our end within reason. Items that weigh 25lbs and up that are left over 30 days will revert back to TCAC with a 25% re-inventorying fee. Items left over 30 days will require a $75 storage fee per month. 5. Our on-line auctions move quickly! If you are interested in an item, bid quickly. If you win an item in the auction you will be notified by email. In order to have enough time to conduct authorizations, registration must be completed at least 24 hours in advance of the auction. If it is a multiple day event, 24 hours prior to the first day of the auction. If the day before an auction falls on a holiday or weekend, the deadline is the day before the holiday or the Friday prior to the auction. 6. In order to better serve our customers, all bidders must provide their name, address, daytime phone number, and email address at which they can be contacted. This is to insure good communication between TimberCreek Auction LLC and the bidder throughout any transactions. 7. The purchaser agrees to pay all reasonable attorney fees and costs incurred by the auction company in the collection of funds. The purchaser also agrees that a fee of 10% per month be added to the balance of any unpaid balance due the auction company and any other costs or losses incurred by the purchaser is failure to adhere to these terms. Any debt collection or dispute proceedings will be heard in Houston County, Alabama. 8. The auctioneer has the sole discretion to advance the bidding and may reject a nominal advance, should it in his estimation prove injurious to the auction. The auctioneer shall be the final judge in all bidding disputes and shall name a bidder as the purchaser. 9. The auction company shall not be held responsible for any "missed" bids or bids unseen by the auctioneer. 10. All sales are final. 11. Firearms: It is the bidder's responsibility to know if a particular firearm is legal in his/her state. It is the bidder's responsibility to know if any criminal charges prohibits oneself from owning a firearm, DON'T BID. Guns will be delivered to a local gun retailer, Area 51 in Dothan, AL. It is the winning bidder's responsibility to provide a local licensed dealer in his/her state to receive transfer of fireguns, with the exception of black powder firearms. If bidder's background check prohibits transfer of firearms, Timbercreek Auction reserves the right to refund or not refund Bidder's monies.
