THIS IS A 'TIMED & ONLINE ONLY' INTERNET AUCTION AUCTION DATE: Wednesday, September 20th beginning at 5 pm Bidding closes on the first item on September 30th at 5 pm Eastern Time and then closes 1 item per minute thereafter to the last item in catalog order. Any bidding in the final minute will automatically extend that item's close time by 2 minutes. Now open for pre-bidding. PLEASE READ: At the request of the auction company, this auction permits bids to be placed by the auctioneer, an employee of the auctioneer, or the seller or an agent on the seller's behalf. You agree that all information that you provide during the registration process will be true and accurate. You will be banned from participation in the RCB's future auctions indefinitely should you provide any false information during the registration process. Applying for Tax-Exempt Status: Some bidders may be exempt from payment of applicable taxes. If you wish to apply for tax-exempt status, you must submit a completed copy of the Commonwealth of Virginia tax-exempt form prior to this auction closing. In State Tax Exempt buyers must use Virginia Form ST-10 and Out of State buyers will use Virginia Form ST-14. RCB requires bidders to submit a new tax-exempt form for every sale. Once you have completed your tax-exempt form, please e-mail the form to realauctions123@gmail.com for approval. If you do not follow these procedures prior to the end of any given auction RCB will not consider you as being eligible for tax exempt status and you will have to apply directly to the state for a refund. Please review the form and its contents carefully, and contact RCB with any questions. Unless otherwise noted everything is being sold in 'AS IS - WHERE IS' condition, with no guarantees stated or implied. All Buyers are cautioned to make their own determination of value and suitability for any specific use. The assets are being sold by bid, bulk bids or separate bids as determined by RCB. Please be comfortable with what you are bidding on. Once you are determined to be the winning bidder there are No refunds, returns or exchanges at any time. Successful Bidders assume full responsibility for purchased items at the time the Auctioneer says Sold, or otherwise awards the sale. By virtue of participating in this sale all bidders signify their acceptance of all Terms and Conditions of the sale including the acceptance of a 'no charge back' policy in instances where the method of payment is by credit card. Payment: On title passing to the highest bidder acknowledged by RCB and subject to all the conditions set forth herein, such bidder will immediately pay the full purchase price. Payment in full is due at the time of sale. Any bills, for any reason, not paid in full within 5 days of the date of the sale close will accrue interest at a rate of 1.5% per month. In addition, the purchaser may be subject to one or more of the following actions: 1. Any and all legal remedies available to RCB and/or its consignors by law including without limitation the right to hold the purchaser liable for the total purchase price; 2. Immediate cancellation of the sale, with RCB retaining as liquidated damages all payments made by the purchaser; 3. Resale of the property at public auction, wherein the original purchaser shall be liable for any deficiency, costs, and RCB's commission on both sales. At RCB's option, payment will not be deemed to have been made in full until RCB has collected all funds due. Accepted forms of payment include Visa, and MasterCard, and (by prior arrangement;) wire transfer and cashier's check. You must have available balance on your credit card for your online purchases. At the conclusion of the auction your credit card on file will be automatically charged for the entire amount of your purchases. Bidders who have two failed attempts to process their charges will have their bidding account suspended and will be required to have a $1,000.00 cash deposit held in RCB escrow for a period of 1 year in order to reactivate their account. Bidding Errors: If you mistakenly 'bid against yourself, place your bidder number in the bid field, or make a gross error you must immediately contact our office by email using the contact sheet on our website (we must have your request in writing) until resolved you must remain the high bidder. If you bid on the wrong item we will not reverse your bid - please carefully review all bids prior to submitting. RCB will not reverse bids for any reason within two hours prior to the auction close. Removal: Payment must be made prior to the removal of any item from the designated premises. If picking up all paid invoices must be shown to auction security staff upon departure and all removals must be completed within the posted time frames or otherwise by special arrangement with auction management. Personal and Property Risk: Persons attending during exhibition, sale or removal of goods assume all risks of damage of or loss to person or property and specifically release RCB and Sinclair & Associates, Inc., and all consignors from all liability therefore. Neither the Auctioneer nor company principals shall be liable by reason of a defect in, or condition of, the premises. Vehicle Sales: Assignment of Title and removal of all vehicles will be subject to Buyers method of payment. Such Assignments and removals for Bidder accounts paid by any method other than cash will be subject to the clearance of remitted Bidding Procedures. Method, order of sale, and bidding increments shall be at the sole discretion of RCB. RCB reserves the right to delete or add items at its discretion. Unless 'Absolute' RCB may at its sole discretion act to protect the interest of buyers and sellers as an agent, by bidding on their behalf. RCB may open bidding on any item by placing a bid as an agent for any buyer or seller. RCB may continue to bid as an agent for a buyer or seller, either by placing consecutive bids or by placing bids in response to other bidders. RCB may, at its sole discretion, change, modify or alter bidding procedures and conduct auctions, or cancel or postpone auctions, at any time including after the beginning of any auction. Announcements verbal, written, online or otherwise) made on the day of the auction shall be binding over all printed material or oral statements made. Limitations: These Terms and Conditions do not - nor are they intended to - create any agency-, partnership-, joint venture-, employer- employee-, or franchiser-franchisee relationship. These Terms and Conditions cannot be altered except in writing by the Auctioneer. Severability: If any term, provision, paragraph, condition, or other portion of this agreement - or the application of these to any person, place, or circumstance - is held to be invalid, unenforceable, or void, the remainder of this agreement and such term, provision, covenant or condition as applied to other persons, places and circumstances will remain in full force and effect. Governing Law: These Terms and Conditions will be governed by and construed under the laws of the Commonwealth of Virginia and their designated venue will be Richmond, Virginia. Entire Agreement: Unless modified in writing these Terms and Conditions contain RCB's entire agreement and supersede any prior oral or written agreements.
