ALPHA INDUSTRIAL POWER INC. BATTERIES, NICKEL CADMIUM, POCKET PLATE TRANSLUCENT CASE

1. All persons attending the exhibition, sale, or removal of merchandise assume all risks of damage to person or property and specifically release and indemnify Maas Companies Inc and/or Seller, from any liability. 2. All property is sold AS-IS, WHERE-IS and ALL SALES ARE FINAL. Subject to Prior Sale. Subject to Owner Confirmation. Selling Property is open to thorough public inspection. It is the Bidder's responsibility to determine condition, age, genuineness, value or any other determinative factor. Maas Companies Inc and/or Seller may attempt to describe the merchandise in advertising, on the internet and at the auction but makes no representations. In no event shall Maas Companies Inc and/or Seller, be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpose. Bidder shall be the sole judge of value. 3. All internet Bidders agree to pay a buyer's premium equal to Thirteen Percent 13% of the hammer price of each item they purchase. 4. Bidders who bid from off site and are not present at the live auction or preview understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. It is the Bidder's responsibility to determine condition, age, genuineness, value or any other determinative factor. Maas Companies Inc and/or Seller shall endeavor to describe in detail each item and any pertinent information about it. Maas Companies Inc and/or Seller will not be responsible for any errors or omissions in the description of the merchandise. ACCURACY OF DESCRIPTION NOT GUARANTEED, ALL ITEMS SOLD AS-IS WHERE IS WITH NO WARRANTIES OR GUARANTEES, EXPRESSED OR IMPLIED. Bidder agrees that everything is sold as is and that they may not return any item they purchase for any reason. 5. Maas Companies Inc and/or Seller, is providing internet bidding pre-auction as a service to Bidder. Bidder acknowledges and understands that this service may or may not function correctly the day of the auction. Under no circumstances shall Bidder have any kind of claim against Maas Companies Inc and/or Seller, or anyone else if the internet service fails to work correctly before or during the live auction. Maas Companies Inc and/or Seller will not be responsible for any missed bids from any source. Internet bidders who desire to make certain their bid is acknowledged should use the proxy-bidding feature and leave their maximum bid 24 hours before the auction begins. Maas Companies Inc and/or Seller reserve the right to withdraw or re-catalog items in this auction. 6. The auctioneer shall advance the bidding at his own discretion. Maas Companies Inc and/or Seller may withdraw any item before or during the auction. Should a tie or a dispute arise between two bidders, the auctioneer may, at his discretion, reopen the bidding until the property is sold. The record of the auction made by Maas Companies Inc and/or Seller shall be conclusive. 7. Terms are Wire Transfer. Internet bidders must make complete payment, no later than Friday, July 26 at Noon. Sales tax may apply. Buyers with exemption status must document this at or before registration. 8. EQUIPMENT REMOVAL: The equipment must be removed from the plant sites within 30 days of the auction. Some lots have special removal/load out requirements. Please see equipment catalog for details. Buyers are allowed to use the rigging company of their own choosing for most lots, provided the vendor can supply adequate liability and insurance documentation. Buyers are required to submit a rigging plan within 7 days of the auction. *Lot 6: SPECIAL REMOVAL/LOADING COSTS APPLY: This item is brand new and still located at Superior Boiler Works Inc. 3524 East 4th Avenue, Hutchinson, KS 67501. The buyer will be required to pay a removal and loading fee of $10,000 which will be in addition to the bid price and buyer premium fee. The $10,000 fee is to be paid directly to Superior prior to the boiler being removed from their facility. Buyers will not be allowed to use a rigger of their choosing for this item. Buyers will need to use Superior for removal/loading. Anyone with questions is urged to contact Maas Companies prior to bidding. *Lot 7: SPECIAL REMOVAL/LOADING COSTS APPLY: This item is brand new and still located at the addresses noted in brochure, in the storage yards of Rasmussen Mechanical Services. The buyer will be required to pay a removal and loading fee of $10,000 which will be in addition to the bid price and buyer premium fee. The $10,000 fee is to be paid directly to Rasmussen Mechanical Services prior to the boiler being removed from their facility. Buyers will not be allowed to use a rigger of their choosing for this item. Buyers will need to use Rasmussen Mechanical Services for removal/loading. Anyone with questions is urged to contact Maas Companies prior to bidding. 9. Maas Companies Inc and/or Seller may refuse a buyer's number to anyone for any reason. Bidder agrees to provide any identification Maas Companies Inc and/or Seller may request including but not limited to: drivers license, photocopies of credit cards, Social Security card or Passport. Bidder agrees to comply with any stated additional terms or conditions associated with particular items. 10. We want you to be happy with your purchases. If you have questions about the merchandise the time to ask questions is well in advance of the live auction. No returns are allowed. Thank you for your patronage.
