CORRECTION AND UPDATE: June 20, 2012, the bankruptcy trustee has determined that Infinite Spirits, Inc. is not the owner of a patent for an "extractive distillation package," as described in the auction brochure. Patent #D489627 will be sold at auction as part of Lot #1, but such patent's claim is for an ornamental design for a bottle. Payments may be made with wire transfer, certified funds or cash. Credit cards will be used to verify identity during the registration process, however purchases will NOT be charged to this card. All persons attending the exhibition, sale, or removal of merchandise assume all risks of damage to person or property and specifically release and indemnify Maas Companies Inc and/or Seller, from any liability. 2. All property is sold "AS IS"�, and ALL SALES ARE FINAL. Property is open to thorough public inspection. It is the Bidder's responsibility to determine condition, age, genuineness, value or any other determinative factor. Maas Companies Inc and/or Seller may attempt to describe the merchandise in advertising, on the internet and at the auction but makes no representations. In no event shall Maas Companies Inc and/or Seller, be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpose. Bidder shall be the sole judge of value. 3. All internet Bidders agree to pay a buyer's premium equal to Thirteen Percent 13% of the hammer price of each item they purchase. 4. Bidders who bid from off site and are not present for preview understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. Maas Companies Inc and/or Seller, is providing internet bidding as a service to Bidder. Bidder acknowledges and understands that this service may or may not function correctly the day of the auction. Under no circumstances shall Bidder have any kind of claim against Maas Companies Inc and/or Seller, or anyone else if the internet service fails to work correctly before or during the live auction. Maas Companies Inc and/or Seller will not be responsible for any missed bids from any source. Internet bidders who desire to make certain their bid is acknowledged should use the proxy-bidding feature and leave their maximum bid 24 hours before the auction begins. Maas Companies Inc and/or Seller reserve the right to withdraw or re-catalog items in this auction. 6. The auctioneer shall advance the bidding at his own discretion. Maas Companies Inc and/or Seller may withdraw any item before or during the auction, some items may be subject to a reserve amount being met. Should a tie or a dispute arise between two bidders, the auctioneer may, at his discretion, reopen the bidding until the property is sold. The record of the auction made by Maas Companies Inc and/or Seller shall be conclusive. 7. Payments may be made with wire transfer (posting no later than Wednesday, June 27), certified funds or cash. 8. Buyers of individual lots are responsible to pay for rigging removal of purchased items, in addition to paying Seller for the equipment. (Lots 10-16 are subject to a non-published reserve price to cover the cost of removal. Buyers will be notified at the end of the auction if the reserve prices on lots 10-16 have been met. High bidder for those lots will have the right to raise their bid to meet the reserve price. Seller has the right to not accept any bid on lots 10-16 if reserve prices are not met for each of those lots. Small items must be removed by June 30th or are subject to forfeiture. Buyers of lots 10-16 must contact auction company immediately following auction to schedule removal/loading appointments*. (*Buyers will need to provide trucks on designated dates and times. Buyers not able to have trucks available for loading at designated times might be subject to additional loading fees. Buyers are responsible for any palletizing/blocking/strapping of tanks/piping. Buyers will need to have a representative onsite during loading to oversee the loading process.) Under no circumstances will any items remain onsite after Friday, July 6. Items left after Friday, July 6th are subject to forfeiture/storage fees. 9. Maas Companies Inc and/or Seller may refuse a buyer's number to anyone for any reason. Bidder agrees to provide any identification Maas Companies Inc and/or Seller may request including but not limited to: drivers license, photocopies of credit cards, Social Security card or Passport. Bidder agrees to comply with any stated additional terms or conditions associated with particular items. 10.Entirety offers are encouraged and must be submitted to Auctioneer with a 20% (non-refundable deposit if offer is accepted) by Thursday, June 21, 2012, 5:00 p.m. (CDT). Trustee reserves the right to negotiate with the entirety bidders to determine the highest entirety bid (the "Entirety Bid"�). However, Auctioneer reserves the right to continue to accept bids on any individual lots beyond such time if, in its determination, there is active bidding. Active bidding� shall be defined as the receipt of a valid bid within two minutes of the last valid bid, notwithstanding that such bid is made after 12:00 p.m. (CDT) on June 26, 2012. In the event the cumulative value of the online bids is higher than the Entirety Bid, then Trustee shall provide the holder of the Entirety Bid with an opportunity to increase its offer by $10,000 over the cumulative amount. In the event that the holder of the Entirety Bid increases its offer to surpass the total of the online bids, then Auctioneer shall promptly provide notice of the revised Entirety Bid to online bidders. The auction shall end when either the revised Entirety Bid or the total cumulative online bids are the highest total bid received by Auctioneer. If Entirety Bid is accepted by trustee, then piecemeal bids obtained on proxibid.com will not be accepted.
