Powers Auction Service nor its employees intentionally misrepresent equipment or mislead buyers with descriptions or pictures. Any errors or misrepresentations of equipment DOES NOT and SHALL NOT negate the buyers responsibility to pay for their winning bids. Powers Auction Service makes every attempt to obtain accurate equipment information from their consignors and to correct any catalog errors prior to auction day. It is the Buyers responsibility to ensure that each piece of equipment meets or exceeds their expectations before placing any bids. By placing a bid, the bidder signifies that they have examined the equipment to their satisfaction, or that they have chosen not to personally examine the equipment. Bidders who bid online and are not present for the preview understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person and are bidding on the equipment as represented to them on the online catalog. Bidder preview is strongly encouraged.

In no event shall Powers Auction Service be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpose. Bidder shall be the sole judge of value, and it is solely bidder's responsibility to determine condition, age, genuineness, value or any other determinative factor. Should a dispute arise between Powers Auction Service and any bidder, Bidder waives any right to a trial or hearing in a court of law and Powers Auction Service is completely non-liable for any dispute between bidder and Powers Auction Service. Bidder agrees to settle the dispute through arbitration in Green County, Wisconsin should any arise. Bidder agrees that under no circumstances will they initiate a charge back on their credit card. Bidder agrees that everything is sold As-Is and that they may not return any item they purchase or receive any refund whatsoever. Powers Auction Service is providing internet bidding as a service to the Bidder. Bidder acknowledges and understands that this service may or may not function correctly at any time. Under no circumstances shall bidder have any kind of claim against Powers Auction Service or anyone else if the internet service fails to work correctly before or during auction. Powers Auction Service will not be responsible for any missed bids from any source. Powers Auction Service may withdraw or re-catalog any item on this auction at their own discretion and without notice.

There is a 2.5% Buyer's Premium Per Item Purchased. Wisconsin Sales Tax of 5.5 % Applies - Farm Use or Resale will be considered to applicable equipment once the proper Wisconsin Sales Tax Exemption Form has been completed. Titled Vehicles are Charged a $50 Title & Registration Document Processing Fee ALL ONLINE PURCHASES MUST BE SETTLED FOR WITHIN 3 DAYS AFTER THE AUCTION

Please Check Junk and Spam Folders All Invoices will be emailed to winning bidders at the end of the auction to the email address you are registered with on EquipmentFacts & Proxibid. Please verify that your email address is up to date. If you have not received your invoice please check your Spam and Junk email folders. All internet purchase must be paid for within 3 Business Days. Payment Options: Cash, ACH, Credit Card (Visa, MasterCard, Discover, American Express). ALL card transactions are subject to a 4% Convenience Fee. Wire Transfers are subject to $30.00 Wire Transfer Fee for all U.S. Transfers and $45 Wire Transfer Fee for all International Wires. Checks with Certified Bank Letter of Approved Credit to be emailed to Powers Auction Service. Any Bidder Invoices not paid within 3 Business Days may have their bid forfeited and equipment may no longer be available for purchase as it may be returned to consignor. All unpaid invoices will be reported to EquipmentFacts & Proxibid in an attempt to collect all unpaid invoices which may result in your bidding rights being revoked with EquipmentFacts & Proxibid.
