TERMS:
Entry: One (1) submission per auction, per entrant. Submission is defined as submitting the Online Google Form (We do not accept submissions by email or phone). Any incomplete entries will be considered invalid, no corrections can be made post submission. Each auction is its own hunt! For example, if there are 10 auctions in the quarter and you identify all the lots with ducks for each auction you will have 10 chances in the quarterly drawing.
Drawing: At the end of each quarter (based on a calendar year), all correct entries will be entered, and a winner drawn. The winner will receive up to $500 in auction credit (no cash value) and notified via email. The winner is eligible to spend up to $500 credit at a SINGLE auction in the FOLLOWING QUARTER, no matter how much the winners personal auction total is. $500 must be used in SINGLE auction of winner’s choice, it cannot be rolled over into any other auctions and is non transferable. The name on the submission must match the name from the auction site.
Exclusions: Not all items eligible for credit, and not all auctions in the quarter will be considered "open" due to other restrictions. Specifically, any Bankruptcy related Commercial auctions, Auto Auctions, or any Real Estate auctions will not contain ducks. An info lot will be provided on auctions in which duck season is "Open". No purchase necessary to participate.

Your credit card will be processed for the full amount of sale immediately following close of the auction (unless PRIOR alternative payment arrangements have been made with Thomas Hirchak Company).

REGISTER TO BID: Registration at the auction finalizes each bidder's agreement to the terms and conditions of sale as stated in the Contract and any Addenda which are incorporated by reference into your bidding. Do not bid until you have read and understand the terms and conditions. In order to bid at the auction, each bidder must be signed up and register to bid through Proxibid.com. There is no fee to register, although a valid credit card will be required to verify identity and funds. By bidding you are representing to Thomas Hirchak Company (Auctioneer) and the seller that you have read and agree to be bound by the terms and conditions for this sale as stated herein. If you do not agree with any of the terms and conditions stated DO NOT BID! By bidding you agree to all disclosures.
BEFORE PLACING A BID: It is important that you are familiar with the terms and conditions as all sales are final. The terms of sale are non-negotiable. Buyer is responsible for all costs and fees associated with purchase and removal of items - no refunds.
THE SALE WILL BE CONTROLLED BY THE AUCTIONEER PROGRAM: Thomas Hirchak Company is not responsible for malfunctions or system errors which cause a bid or bidder to fail to be recognized or registered. If there is a dispute, the Auctioneer may re-open the bidding at the Auctioneer's sole discretion and shall serve as the sole arbiter as to who is or is not allowed to bid.
ITEMS SOLD AS IS, WHERE IS: Thomas Hirchak Company has made every attempt to fully disclose any known condition of product being sold. Auction items are sold 'AS IS, WHERE IS' with no financing, inspection or other contingencies to sale. Buyers are responsible for conducting their own due diligence and investigation of each auction prior to making a bid and purchase at the auction. Buyers must rely solely upon their own investigation and not any information provided by the Seller or Auctioneer. Failure of a Buyer to be fully informed on the condition of an item will not constitute grounds for any claim adjustment or right to cancel sale.
PICK UP OF ITEMS: Item(s) MUST be completely removed from auction site on specified day. Please bring appropriate means to load and haul your items including but not limited to boxes, packing material, any necessary tools, ladders, or other equipment involved with the disassembly or removal of items. Any items not picked up on the specified day will be considered 'ABANDONED'. Buyers that do not show up for scheduled load outs and do not communicate with THCo will have all winning lots considered, 'ABANDONED WITHOUT REFUND.'
Buyers must make any transport requests 24 hours prior to auction closing email helpdesk@THCAuction only. Buyers may not make transport arrangements with any other THCo staff.
Transport fees are at minimum $50 per Lot regardless of invoice total. THCo reserves the right to refuse transport of any items.
Items may only be transported back to THCo Morrisville and must be retrieved by buyer within 48 hours or 2 business days. Items not retrieved within 48 hours are considered, 'ABANDONED WITHOUT REFUND.' No exceptions.
RESERVES: Auctioneers reserve the right to either lift reserve prices or introduce reserve prices. If you are the high bidder on a lot when a reserve is lifted and are not outbid, you are obligated to purchase the lot. If you are unclear on this, please do not bid. In circumstances deemed necessary, the auction may be postponed to a later date, or if needed, the auctioneers reserve the right to cancel the auction entirely. In addition, the auctioneers have the prerogative to extend the auction beyond its initially scheduled conclusion and may exercise their discretion to undertake any other essential actions to ensure the smooth and equitable conduct of the auction process.
YOU ARE ENTERING INTO A BINDING CONTRACT. THERE ARE NO REFUNDS OR BID CANCELLATIONS.
